1. Scope

These Terms & Conditions (T&C) apply to the use of the platform www.perfect-aupair.com – a service of it-soft GmbH, Wendl-Dietrich-Str. 22, 80634 Munich, Germany (hereinafter referred to as "Provider").

The platform facilitates contact between au pairs and host families worldwide. By registering and using the platform, users accept these T&C.

2. Services of the Provider

Perfect-Aupair.com offers the following services:

• Creation and management of a profile (au pair or family)
• Use of the internal messaging system
• Access to publicly available profiles
• Contact matching based on search criteria (matching)
• Optional additional features (e.g., premium functions)

There is no entitlement to successful placement or to specific availabilities.
The Provider reserves the right to change or restrict content or functions at any time.

Perfect-Aupair is a contact and matching platform, not an employer or au-pair agency, and is not a party to agreements between au pairs and host families. Users must independently verify identity, suitability and information and comply with residence, visa, employment, tax and insurance rules.

Suggestions and ranking are mainly based on user role, selected filters, country, languages, availability, profile completeness, matching information and recency. Users can influence them through profile and search settings. Content may be restricted or removed following reports and manual or technical review signals. 3. Registration and User Account

Use of the platform requires prior registration. Users must:

• be of legal age (at least 18 years)
• provide truthful and complete information
• keep their login credentials confidential

A user account is non-transferable.
The Provider may suspend or delete accounts in case of violations of these T&C or applicable law.

4. User Obligations

Users agree to:

• not provide false or misleading information
• not publish unlawful, offensive, or discriminatory content
• not distribute advertising, spam, or malware
• only use their own photos and content
• not use automated tools (e.g., bots, scrapers)

Violations may result in immediate suspension or deletion.

5. Costs of Use

Registration, profile creation or an entry tariff may be offered at €0.00, depending on the user role and current product. The services, duration and final price displayed immediately before activation or purchase apply. Host families need an active host-family tariff with an available job slot to publish an au-pair offer; a draft may be saved beforehand. A €0.00 tariff may still require explicit activation.

Payments are currently processed through PayPal in the web checkout. The payment provider’s terms and privacy notice also apply. Automatic renewal occurs only if it is expressly displayed and agreed before purchase.

6. Contract Duration & Termination

The user account continues for an indefinite period; the duration and scope of a tariff are defined by the relevant order. Users may terminate through the available account function or by email. Tariffs do not renew automatically unless this was expressly displayed and agreed before purchase.

The Provider may restrict or terminate an account after appropriate warning for serious or repeated breaches. An immediate temporary suspension is permitted for illegal content, fraud or security risks. Statutory retention duties remain unaffected.

7. Disclaimer of Liability

The Provider has unlimited liability for intent and gross negligence, injury to life, body or health and under mandatory law. For a slightly negligent breach of an essential contractual duty, liability is limited to foreseeable damage typical for the contract. Liability is otherwise excluded to the extent permitted by law.

The Provider does not adopt user content as its own and gives no guarantee regarding its accuracy, a user’s identity or suitability, or conduct outside the platform. Profile review or approval is not a safety, identity or placement guarantee.

8. Changes to the T&C

These Terms may be amended for legal, security or technical reasons or because of a reasonable change to the service. Users will be informed of material changes in good time by email or at login.

Where consent is required, it will be requested expressly; silence alone does not constitute acceptance. Without consent, the previous provision continues where legally and technically possible. Otherwise the contract may be terminated with reasonable notice. Statutory rights remain unaffected.

9. Final Provisions

• German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
• Place of jurisdiction is Munich, as far as legally permissible.
• Should individual provisions of these T&C be wholly or partly invalid, the validity of the remaining provisions shall not be affected.
